Discipline is a difficult but essential part of supervising and managing employees. This online CALPELRALearn program provides the tools you need to make disciplinary decisions and implement effective discipline consistent with California's due process and other protections. You’ll learn:

  • How to make sure discipline sticks; avoid losing your agency's case at arbitration or other appeal hearing.
  • How to decide on the appropriate level of discipline; what factors should you consider?
  • What is "just cause" for discipline? When is progressive discipline required?
  • What is due process?
  • Which employees are entitled to due process?
  • Do at-will and probationary employees have any protections?
  • Who should conduct the Skelly hearing, and how should it be conducted?
  • What is the union's role in the disciplinary process?
    • Determining what information the union and employee are entitled to receive.
    • Strategies for effectively handling interfering union representatives.
    • Anticipating most common defenses (disparate treatment, lack of training, anti-union bias, insufficiency of investigation, etc.).

The program includes practical advice and best practices for:

  • Setting up for success from the earliest stages of discipline, including:
    • Identifying and honestly assessing case weaknesses.
