This online core Academy focuses on the obligations involved in the duty to bargain, the tests for determining which issues are subject to bargaining, and the necessary planning for successful bargaining:
- Duty to bargain under California law, including:
- Elements of the totality of circumstances test; per se violations including unilateral changes and providing information to unions; effects vs. decision bargaining; remedies for violations of the duty to bargain; and overview of the PERB process.
- Scope of bargaining under California law, including tests for determining mandatory subjects and how these tests apply.
- Rules for drafting labor contract provisions.
- Bargaining preparation and organization.
