Impasse And Unilateral Adoption During Economic Crisis

The Program
This program was specifically developed to assist public agencies with the numerous impasses and unilateral impositions during these difficult economic times. The program focuses on how to complete in good faith the impasse and unilateral implementation process for MMBA, Trial Courts, EERA, Dills, and HEERA agencies.

Program Content
In this program, you'll learn:

  • Why impasse and unilateral adoption must be part of your planning during this economic crisis.
  • To apply the legal requirements of good faith during the impasse and post-impasse implementation processes.
  • Why unilateral adoption is a high risk process, and how to minimize the risks.
  • To determine when you are legally at impasse, and how that impasse can be broken.
  • To avoid a continuous process of impasse, revival, deadlock, and revival.
  • To utilize the statutory limitations under the various collective bargaining statutes.
  • To manage the mediation process, if your agency participates.
  • How the scope of bargaining plays a critical role in declaring impasse and determining whether a party is guilty of proceeding to impasse in bad faith.
  • The connection between negotiating the "decision" and "effects" and when an agency can unilaterally implement a change.
  • How to structure your last, best, and final offer, and the legal requirements for implementing the LBFO.
  • To understand the employer's right to adopt a LBFO also occurs at the same time as the union's right to strike.
  • How to live with the reset status quo after implementation, and the myth of the one-year duration.
  • How to deal with the duty to revive negotiations after implementation when there is a "changed circumstance."
  • To prepare for potential work action when adopting a LBFO.

Who Should Attend?

  • Individuals who will likely be involved in impasse and post-impasse unilateral adoption during the next three years.
  • Individuals who will be integrally involved in the planning and implementation of cost-savings measures that are likely to be undertaken in the next two years.
  • Individuals responsible for administering their agency’s labor relations and/or responsible for preventing unfair labor practices.
  • Experienced labor relations professionals from cities, counties, school districts, trial courts, special districts, transit agencies, state university, and state agencies.
  • Attorneys representing public agencies and interested in MCLE credit.
  • Individuals certified by CALPELRA for Academies 1, 2, and 3 who are interested in additional advanced training. Although Academy 7 is an advanced Academy, prior completion of Academies 1 – 3 is not a prerequisite.

Learning Style
The program will incorporate a variety of adult learning styles that make the Academy series so popular, including interactive exercises, pre-tests and pre-reading, small group planning, and audio/visual reinforcements.

Trainers
Academy 7 was developed and will be taught by individuals with years of substantial experience in California labor relations and employment law, and who have high ratings as CALPELRA trainers. The program will draw on the trainers' most recent public sector experiences.

William F. Kay
CALPELRA Academy Co-Director. Over 40 years of public sector labor relations and employment law experience representing California public agencies under PERB's jurisdiction.

M. Carol Stevens
CALPELRA Executive Director. Over 35 years of experience representing California public agencies including cities, counties, school districts, transit agencies, and special districts.

Registration Fees
The registration fee includes all materials for this program, a resource book, continental breakfast, refreshments, and lunch. Hotel costs are not included in the fees and each attendee must make independent hotel reservations directly with a nearby hotel. CALPELRA will reserve a block of rooms at a discounted rate whenever possible.

To Earn A Certificate
A Certificate of Attendance will be provided for attendance at each Academy.

MCLE credit and HRCI credit is available.
